📜 Terms of Service for the CMS Software Nexpell

1. Subject of these Terms of Service
Nexpell is a free, self-hosted content management system (CMS) for creating and managing websites.
These Terms of Service govern:
- the use of the Nexpell software
- the use of optional update and plugin infrastructures operated by the project
Hosting, operation, or content management of websites are not part of Nexpell.
2. Nature of the Software
Nexpell is provided as a locally installable CMS software and is operated by the user on their own or third-party infrastructure at their own responsibility.
Nexpell is:
- ❌ not a hosting provider
- ❌ not a service provider
- ❌ not a website operator
- ❌ not a content provider
3. User Responsibility
The user is solely responsible for:
- content created or published using Nexpell
- the legal compliance of the website
- compliance with all applicable laws
- data protection and data security
- operation, maintenance, and security of the installation
Nexpell assumes no responsibility or liability for website content or operation.
4. Optional Update and Plugin Infrastructure
To support the software, Nexpell operates optional server infrastructures, in particular for:
- core updates
- plugin installer and plugin registry
- theme downloads
- version and update checks
- related API services
This infrastructure serves solely to improve convenience and maintenance of the software.
5. Voluntary Nature of the Services
Use of the update and plugin infrastructure is voluntary. The Nexpell software can generally be used without these services.
Nexpell reserves the right to:
- restrict services
- modify services
- or discontinue services at any time
6. Prohibited Use of the Infrastructure
The update and plugin infrastructure must not be misused, in particular for:
- illegal or fraudulent business models
- misleading or unlawful advertising
- deception regarding identity, origin, or authorization
- circumvention of technical protection measures
- automated or manipulated access
- unauthorized redistribution of plugins or updates
7. Restriction or Revocation of Access
In the event of misuse or violations of these Terms of Service, access to the update and plugin infrastructure may be partially or fully restricted or revoked.
Possible measures include:
- restriction to security-related updates
- deactivation of plugin downloads
- complete withdrawal of access to update services
These measures apply exclusively to the server services operated by the project.
8. No Interference with Third-Party Systems
- no deactivation of plugins on user systems
- no deletion of content
- no modification of configurations
- no interference with running websites
The local installation always remains fully under the control of the user.
9–11. Further Provisions
- Use of the software and services is at the user’s own risk
- Changes to these Terms of Service are reserved
- If any provision is invalid, the remaining provisions remain unaffected
- The law of the Federal Republic of Germany shall apply
